Italy watchdog orders Meta to halt WhatsApp terms barring rival AI chatbots

The Italian antitrust regulator, AGCM, has mandated Meta Platforms to suspend some WhatsApp provisions that could hamper other AI bots from being used on its services. This follows an investigation against Meta Platforms for allegedly taking advantage of its dominant position in the marketplace.

Meta has criticized the decision severely, with a spokesperson saying “the decision is fundamentally flawed” in an explanation of why Meta feels the decision has been made. This comes after the AI chatbots have put an unprecedented burden of use upon a system which was never intended for such a task.

The move is the latest step in a series of actions taken by European regulators against the big tech firms, as the European Union seeks to support innovation and reduce the growing power of Big Tech. In a statement, the AGCM said Meta’s practices could reduce production, limit entry into the market, or hamper technical progress in the market of AI chatbot services offered to consumers.

The Italian regulator began the investigation of Meta in July last year in relation to concerns of abuse of the dominant position in the market as a result of the misuse of the position of WhatsApp. However, in November, the scope of the investigation widened to include the new terms of the business platform of the service provider WhatsApp.

“Thus, these contractual conditions effectively grant Meta AI’s competitors in the AI chatbot services market an exclusion from the WhatsApp platform,” the AGCM explained in the statement.

The European Union announced the begining of its own probe last month regarding the same issue. Europe’s stricter regulatory regime, which is arguably much tighter compared to the conducive regulatory regime found in the United States, has faced criticism from various quarters, including the technology giants of the US. The case has also received criticism from the administration of U.S. President Donald Trump.

The AGCM is currently working in close collaboration with the European Commission in order to ensure that Meta’s behavior is addressed in “the most effective way,” given the current investigations of the company’s practices.
